Terms of Service

1. User Responsibility

• Review of Terms: It is the user's responsibility to review and ensure compliance with the most current Terms of Service (TOS) for any avatars, assets, or content used at the time of use or sale.
• Awareness of Changes: TOS are subject to change. Users must review the specific TOS for each item on the storefront regularly, especially before any usage, transfer, or sale.

2. Intellectual Property and Attribution

• Ownership: Users may not claim ownership of any avatars, assets, or parts included in this package.
• Permissions: Users must contact the individual asset creators or access their links for permission if they wish to use any assets independently.
• Restrictions on Asset Use: Do not extract or use any assets from this model in other projects without proper authorization.

3. Prohibited Actions

• Leaking, Trading, Reselling, or Ripping: Users are strictly prohibited from leaking, trading, reselling, or ripping any packages/assets, in whole or in part.
• Public Use: Avatar packages are intended for private, personal use only. It may not be made publicly available.
• Sharing Restrictions: Avatar packages/assets may not be shared with others, including but not limited to friends, family, or significant others.

4. Purchase Terms

• No Refunds or Chargebacks: Due to digital nature of these products Seakaii cannot offer refunds and advise you read all information provided before purchase. Failure to read the information available is the responsibility of the customer and therefore is not eligible for refunds.
• Gift Purchases: If purchasing as a gift, include the recipient’s information at the time of purchase to ensure the license is accurately assigned.

5. Commissioning Modifications

• Requirements for Commissions: By requesting an edit commission, you confirm that I have the rights to work with any third-party assets involved. If additional assets or ownership rights are necessary to complete the commission, you are responsible for funding these costs. Proof of approval from asset/avatar creators may be required.

• Approval for Commissions: Users must inform me of the commissioned editor’s details and obtain approval prior to sending the package for modification. Commissioning without prior approval constitutes a breach of these Terms of Service.

6. Platform Usage and Attribution

• Permitted Platforms: Users are permitted to use purchased avatars on VRCHAT ONLY.
• Social Media Usage: Users may display avatars on social media (e.g., YouTube, TikTok, Twitch), provided they give credit in the following format:
• Example: “Elaria by seakaii.gumroad.com” or “Elaria by seakaii.”

By purchasing, downloading, or using this package, you agree to comply with all terms outlined above.
